遠雄選定的仲裁人施義芳臨時辭任，昨（22）日無法召開仲裁庭。施義芳受訪表示，因為最近工作太多、太忙，怕耽誤仲裁事宜，才請辭仲裁人。
身為土木技師公會理事長的施義芳說，最近浮洲、林口合宜住宅相繼出事，他工作量增加，而仲裁的事短則六個月、長則九個月才能走完程序，他怕耽誤仲裁時程，因此向台灣營建仲裁協會請辭仲裁人。
外界揣測施義芳不想攪入北市府與遠雄之間的戰爭？施對此否認，並且說，就事論事、就工程論工程。他強調，仲裁人屬「選任」非「委任」，辭仲裁人一事不需事前先跟遠雄報備或討論，仲裁人可以自由意志表示。
了解內情人士指出，施義芳會臨時請辭仲裁人，應該是考量遠雄形象以及大巨蛋案內情過於複雜，施義芳是土木技師公會理事長，對於該案的對錯應該很清楚。此外，施義芳目前是民進黨中執委，曾名列上一屆民進黨不分區名單第26名，施此時請辭可能有「避嫌」考量。
施義芳專業在土木及營建仲裁，經歷包括台灣省土木技師公會理事長、台灣營建仲裁協會理事長、睿誠工程技術顧問董事長、台北市政府營造業懲戒委員會委員。
